1. Overview

1.1 Introduction. This document sets out the terms and conditions which will govern the contractual relationship or agreement (“Agreement”) between you (“you”, “your” or “Buyer”) and Institute of Hospitality (“IOH” or “we”, “our”or “us”) which you will be deemed to have agreed to be bound by when visiting, using or buying from our “Institute of Hospitality” website (the “Website”). We strongly recommend that you read and understand this Agreement, and in any event by continuing to purchase from our Website you will be bound by this Agreement.

1.2 Modification. These are the terms and conditions that apply to the use of the Current Vacancies information. The terms and conditions may be updated by us from time to time without prior notice and which shall automatically take effect and replace the terms of the Agreement upon the later of (a) your next use of the Website; or (b) seven days after it is posted on the Website. You should review these terms and conditions periodically for changes. Particular Current Vacancies may also be governed by additional or alternative terms of service, which will be posted on the website. By using the Current Vacancies pages you are deemed to have accepted these terms and conditions. Your continued use of the Website will constitute your acceptance of the revised Agreement. If you do not agree with the terms of this Agreement or any revised version of this Agreement, do not continue to use the Website.

2. Registration

2.1 Registration. Registration may be required for you to use certain services provided on our Website. You may register with us by providing your real name, address, phone number, and email address. Please refer to our Privacy Policy on our website for more details on how we protect your information.

2.2 Username and Password. You may need a username and password to access certain areas of the Website. You are responsible for maintaining the security of your username and password and you are responsible for any action taken under your username or password. We take reasonable steps to ensure the security of your information on our systems; please visit our website for more information about the security software we employ.


3. Recruitment Advertising

3.1 Commencement of Services. We will not commence the provision of Services until payment is received and cleared. You will receive a confirmation email once your payment has been cleared successfully. You will be notified by email when your job adverts have gone live on instituteofhospitality.org.

3.2  Prices and Payment. Prices are guaranteed until displayed on the website and are subject to change. A job posted on instituteofhospitality.org will remain live for 3 months or until the closing date of the vacancy, whichever is earlier. Any extension of this time on request will be charged to the Customer as a new posting. Any jobs posted in addition to the agreed number of jobs will be discarded. If a customer reposts a job or posts another, this will be classed as two jobs. If any Services to be used within any time period specified on the item description are not used within that period of time they may not be carried over into any subsequent period without our prior written consent. The Customer will be responsible for payment for any unused Services. All prices exclude VAT.

3.3 Advertising Rules. We have rules regarding the content and format of jobs posted on instituteofhospitality.org. Their purpose is to ensure that users who search the site get results which are presented as clearly and informatively as possible. You agree that we may, at our discretion and without liability to you, remove from instituteofhospitality.org any advertisement which is posted in breach of these rules. The rules may change from time to time and you are advised to refer to them regularly.

The Rules are:

  1. No duplicating of jobs at the expense of other clients’ jobs.
  2. No gratuitous use of keywords in job descriptions or job titles. Gratuitous means deliberately inserting words, strings of words, or repeating job titles, with the intention of increasing the number of page views.
  3. Job advertisements placed on instituteofhospitality.org must be for genuine vacancies only, and not for other products or services, either relating to or unrelated to recruitment including, but not limited to, affiliate schemes, pyramid selling schemes or any other so called ‘business opportunity’.
  4. URLs or email links (live or text only) are not permitted in the body copy of the job description page. Email links are permitted from the ‘Contact email’ link. URL linking is permitted from the ‘apply online’ link which is available on request to jobs@instituteofhospitality.org. If your advertisement links to another site via our external apply online option, you are responsible for maintaining the links and for the content of your advertisement and the linked site. We may remove from instituteofhospitality.org any advertisement which contains content or links to a site which, in our opinion, is defamatory, illegal or objectionable or will bring the Institute of Hospitality into disrepute. You will indemnify us from and against any claims or liability arising from content or links contained in your advertisements.

3.4 Illegal Advertisements. Advertisements which appear to discriminate on grounds of sex, race or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher. If we believe that an advertisement may be discriminatory we may at our discretion either amend the advertisement or remove it from instituteofhospitality.org without liability to you to make any refund of amounts paid or due to be paid in respect of the posting or otherwise and will inform you accordingly.

3.5 Responses to advertisements. You agree to deal fairly and professionally with individuals who may respond to an advertisement you have posted and not do anything which may bring Institute of Hospitality into disrepute. You will indemnify us from and against any claim brought by an individual against the Institute of Hospitality arising from your breach of this obligation or any other of these terms and conditions.


4. Liability and Indemnification

4.1 Liability. We accept liability for any losses you suffer only up to a maximum amount of the value of the product plus any VAT which you have paid in respect of any transaction. We will not be responsible for any indirect losses including consequential, exemplary, special or punitive damages, including lost opportunities or loss of profits even if we have been advised of the possibility of such damages. We accept no responsibility for the content of advertising material, including, without limitation, any error, omission or inaccuracy therein. We cannot guarantee that:

  • details of vacancies will be current, complete or accurate
  • applications for vacancies will be successful
  • candidates are suitable for the job advertised and have the required qualifications and personal characteristics.
  • the provision of the services will be uninterrupted or error-free


5. Warranties

5.1 True information. You represent and warrant that the information you have submitted to us in your registration or order is true, accurate and complete. You agree not to use false names or addresses, or any other false information, in using the Website.

5.2 Legal Compliance.
 You represent and warrant that, during any interaction with the Website you will comply with all applicable local, regional, national and international laws. You also represent and warrant that you are 18 or over and therefore able to enter into legally binding contracts.


6. Information

6.1 Copyright. The content and software on this site is the property of Institute of Hospitality and/or its suppliers and is fully protected by UK and international worldwide trademark and copyright law. You can download, print and copy material from Current Vacancies for your own personal non commercial use, but you must not reproduce any part of the material unless we have granted you permission to do so. Permission can be sought from jobs@instituteofhospitality.org.


7. Other Terms

7.1 Jurisdiction. This Agreement is governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non exclusive jurisdiction of the English Courts.

7.2 Notices. Except as expressly stated otherwise, all notices should be sent to the Institute of Hospitality, Trinity Court, 34 West Street, Sutton, Surrey, SM1 1SH,  United Kingdom. Except as expressly stated otherwise, all notices to you shall be sent to the email address you provided to us during the registration process. Such notice shall be deemed as given one business day after the email is sent.
