New Sentencing Guidelines on the Corporate Manslaughter Act
The Sentencing Council has recently published new sentencing guidelines for corporate manslaughter and health and safety offences that result in a fatality.
A publicity order should be imposed in virtually all cases. The guidelines also state that a corporate manslaughter fine should “seldom be less than £500,000” and the fine for a health and safety offence resulting in death should “seldom be less than £100,000.”
As the first UK corporate manslaughter case comes to trial this month (February 2010), now is a good time to re-read the Institute of Hospitality’s management guide on the subject.
